North Carolina HB2 Bill – Anti-Trans Bathroom Bill…and then some

Tonight I was prompted to actually review the North Carolina Anti-Trans Bathroom Bill, as most people are calling it. It does indeed completely discriminate against Trans people because it requires them to use the bathroom that relates to their “biological sex”. Yes, they use the word sex and not gender. However, there are some other parts of North Carolina’s HB2 that to me are a bit more concerning.

Most people are “up in arms” over the “Bathroom Bill” portion of this. However if I were a North Carolina resident I’d be more concerned about Part II Section 2.1. This Part basically says that local governments are NOT allowed to make any laws or regulations in regards to the Minimum Wage or Paid Sick Leave. So say you live in Charlotte, NC, and the cost of living is higher, your local government NOW cannnot pass a law to raise the minimum wage for your city, or county.

What makes this even more interesting is that at the beginnning of HB2 it specifically talks about the North Carolina Constitution…

  • “Whereas, the North Carolina Constitution reflects the importance of statewide laws related to commerce by prohibiting the General Assembly from enacting local acts regulating labor, trade, mining, or manufacturing in Section 24 of Article II of the North Carolina Constitution; and”

That is taken directly from HB2. Here is a link to the actual Article II of the North Carolina Constitution.

And it does seem true that Section 24 does prohibt the General Assembly from making these laws.

“Sec. 24. Limitations on local, private, and special legislation.

(1) Prohibited subjects. The General Assembly shall not enact any local, private, or special act or resolution:

(j) Regulating labor, trade, mining, or manufacturing;

So… just this part of HB2 seems to be Unconstitional, in North Carolina. And we haven’t even gotten to the Bathroom Bill, although if I were a lawyer I’d assume this applies to that as well, because it’s regulating labor, in a way.

And it just gets worse from there, from how I’m interpreting HB2.

For one, the idiots in North Carolina who wrote this bill are so contradictory it’s laughable. It’s like they didn’t think this through and had someone without any knowledge of this situation write this bill. Maybe they were just trying to be a little accommodating but I doubt it. They specifically put this in the Bill, regarding a “Single Occupancy Bathroom”, eg a Family Bathroom, as most of us might interpret it. Where only one person or family may use that facility at a time.

“Single occupancy bathroom or changing facility. – A facility designed or designated to be used by only one person at a time where persons may be in various states of undress. A single occupancy bathroom or changing facility may include, but is not limited to, a single stall restroom designated as unisex or for use based on biological sex”

So they are basically saying, from what I understand, that Trans people may use these Single Occupancy Bathrooms because the definition of “Unisex” is generally understood as…

“Unisex refers to things that are not gender-specific, being suitable for any gender.”

And since they have used gender and sex interchangeably here, being not “gender-specific” means not “sex (as defined by one’s birth certificate) specific”, then Trans people can use these restrooms.

Now, before we get to the Exceptions to these rules lets discuss “sex” based on one’s Birth Certificate. North Carolina is actually one of the states that allows someone to change their sex/gender on their birth certificate after gender/sex reassignment surgery. This excerpt comes from the Lambda Legal site.

“Statute: N.C. Gen. Stat. §§ 130A-118(b)(4), (e) (2005).

Text: (b) A new certificate of birth shall be made by the State Registrar when . . .
(4) A written request from an individual is received by the State Registrar to change the sex on that individual’s birth record because of sex reassignment surgery, if the request is accompanied by a notarized statement from the physician who performed the sex reassignment surgery or from a physician licensed to practice medicine who has examined the individual and can certify that the person has undergone sex reassignment surgery.

Summary: North Carolina will issue a birth certificate reflecting the proper sex.”

However you can see the same text here on the North Carolina General Assemblye website. It’s a PDF and is part (4) of section (b) of 130A-118.

While this doesn’t help Trans people who have not transitioned or don’t want to transition, it seems a bit contradictory to me to allow someone to change their Gender/Sex, if you didn’t want them using the bathroom in the first place, before they made that transition. It’s basically like the North Carolina General Assembly doesn’t know it’s ass from a hole in the ground.

And now…let’s get to the Exceptions! HB2 allows for certain “Exceptions” for when someone of the opposite “sex”/gender may enter a bathroom, or other facility, that does NOT match their birth certificate. From what I can tell, this first list is specific to Chapter 115C of the North Carolina General Statutes, Article 37. Chapter 115C is specific to “Elementary and Secondary Education”.

(d) Exceptions. – This section does not apply to persons entering a multiple occupancy bathroom or changing facility designated for use by the opposite sex
(1)For custodial purposes.
(2)For maintenance or inspection purposes.
(3)To render medical assistance.
(4)To accompany a student needing assistance when the assisting individual is an employee or authorized volunteer of the local board of education or the student’s parent or authorized caregiver.
(5)To receive assistance in using the facility.
(6)To accompany a person other than a student needing assistance.
(7)That has been temporarily designated for use by that person’s biological sex.”

THEN, this list has the different Exceptions… but from what I can tell they are specific to Chapter 143 of the General Statutes and they are adding a new article 81. But Chapter 143 is specific to “State Departments, Institutions, and Commissions”.

(1)For custodial purposes.
(2)For maintenance or inspection purposes.
(3)To render medical assistance.
(4)To accompany a person needing assistance.
(5)That has been temporarily designated for use by that person’s biological sex.”

Later in the Bill they have a section about “PART II. STATEWIDE CONSISTENCY IN LAWS RELATED TO EMPLOYMENT AND CONTRACTING”, which is where the Minimum Wage comes in, and they do try to reference Chapter 143, Section 760 here…

§ 143-422.11. Legislative declaration.
(a)It is the public policy of this State to protect and safeguard the right and opportunity of all individuals within the State to enjoy fully and equally the goods, services, facilities, privileges, advantages, and accommodations of places of public accommodation free of discrimination because of race, religion, color, national origin, or biological sex, provided that designating multiple or single occupancy bathrooms or changing facilities according to biological sex, as defined in G.S.143-760(a)(1), (3), and (5), shall not be deemed to constitute discrimination.

However according to their own documentation, Chapter 143, Section 422 was repealed back in 1975.

Additionally, it defines those things in Chapter 143 Section 760 but Chapter 143 only applies to “State Departments, Institutions, and Commissions”, not private businesses.

So, returning to the “Exceptions”, I’ll now combine them, now that I know they are basically referring to “Elementary and Secondary Education” and then “State Departments, Institutions and Commissions” and not Private Businesses. It seems that the latter does let you accompany your child or handicapped friend into a State facility to assist them, per (4) above which just says anyone needing assistance, not just a student. Here they are again…
(1)For custodial purposes.
(2)For maintenance or inspection purposes.
(3)To render medical assistance.
(4)To accompany a student needing assistance when the assisting individual is an employee or authorized volunteer of the local board of education or the student’s parent or authorized caregiver.
(5)To receive assistance in using the facility.
(6)To accompany a person other than a student needing assistance.
(7)That has been temporarily designated for use by that person’s biological sex.

What bothers me is that certain things are not defined. “Custodial Purposes” as well as “Custodian” are not defined, neither are “maintenance purposes” or a “maintenance person” nor “inspection purposes” or an “inspector”. That seems to open up a lot of possibilities for child molesters and predators and people with ilicit purposes. Technically, because “inspector” is not defined, especially as an employee of the state, county or city, I could enter the restroom of the opposite sex and claim to be an “inspector” and require everyone show me their genitalia because I can claim to be a “State Genitalia Inspector and I’m required to inspect the restrooom as part of an “investigation”.

That’s Scary!

Of course this doesn’t discount the fact that a pedophile or pervert could be employed by the State, county or city as a “Custodian”, “Maintenance Person” or “Inspector” and then still enter the bathroom of the other “sex” just because they want to, unannounced.

But then on top of that is number (7/5). “That has been temporarily designated for use by that person’s biological sex.” “Temporarily” has not been defined so any of the above institutions could choose to define temporarily as “From now until the day before eternity ends”, and then say that both “Multiple Occupancy” bathrooms are “Temporarily” open to those of the other sex/gender “if that’s how they define themselves”.

Using the GPS for HanDBase plugin to Easily Capture GPS Coordinates in your HanDBase Database on Android

I know that quite a few HanDBase users who have the app on their Android device have been looking for a way to get GPS data into the HanDBase app. While DDH Software is still working on Plugins to make this happen I’ve come up with a fairly simple way to make this work. I created this solution using the app Tasker for Android. Tasker allows you to use scripts to automate tasks on your Android device in a variety of ways. Originally I thought that users would have to install Tasker to get this to work but the developer has an App Creator tool. Once I figured out how to make that work I was able to create a Standalone version of this Plugin so that users can now just install that. I was able to use Tasker to create this app and allow HanDBase users to grab the GPS Coordinates and store them in a field in HanDBase for Android.

If you are interested in automating your Android device in other ways, such as automatically turning off WiFi when you leave home or turning it back on when you get to work I recommend you check out Tasker. You can even create your own apps, like I did with this plugin, including screens to make them look like Android apps.

While this may not be the perfect solution it’s a great workaround if you need to get accurate GPS data into HanDBase on your Android device. At this time the plugin will only capture the GPS Coordinates so you can paste them into your Database. All you’ll have to do is tap a button in a HanDBase form. I will be looking into adding a way to display these coordinates on a map for a future update.

Before you proceed, make sure you have installed the AutoHotKey Macro App on your computer.

After some additional testing I figured out a way in AutoHotKey to automatically select the HanDBase Conduit Partnership, rather than requiring it to be the first Partnership in the list. I have also added instructions for syncing these files between your Android device and Dropbox or Google Drive to make initiating the sync easier, with fewer steps.

Remotely Sync HanDBase for Android with Desktop PC via Cloud. Using Dropbox or Google Drive

Using the following steps I have been able to successfully synchronize HanDBase for Android with my Windows Computer remotely using Dropbox and Google Drive. This set-up enables a record level sync, as opposed to a file level sync using just Dropbox or Google Drive and FolderSync, or some other sync solution. This allows you to edit or add individual records on your Android device and on your desktop or laptop computer simultaneously. This should also work with most other Cloud Storage apps for Android, assuming there is a way to Synchronize folders to their cloud storage but YMMV (Your Mileage May Vary). Please test this first on your end before implementing this on a regular basis, especially if you use a Cloud Storage system other than Dropbox or Google Drive.

It’s better written and has a much better story. That Shades of Grey book, The Real Shades of Grey in my opinion, was written by Jasper Fforde back in 2009, two years before this other book. I’m bothered that it hasn’t gotten the kind of press that this badly written book has. So…I created a Fan site, of sorts. Just a way to get the word out there about The “Real” Shades of Grey. 1910 Working Hamilton Pocket Watch – Railroad Grade 990L – For Sale

This item has since been sold but I’m leaving this post up for reference purposes.

I recently found this “Antique” Hamilton Pocket Watch in my watch collection. I don’t have any recollection of where it came from so I’m interested in selling it. I’ve done quite a bit of research on the details of this watch, which you will find below. From the research I’ve done a watch like this could be worth as much as $400 to $500. Similar watches of this Grade, 990L, are going for that or higher on ebay. This is considered a Railroad Grade watch, meaning it was so accurate that Railroad workers could use them. Hamilton also put a lot of work into it’s movements and they are well known for their artistic damaskeening on the movement which turns this watch into more than just something to tell time by but also into a piece of art.

This watch is in working condition and from what I can tell has all original parts. The movement is very intricately detailed and visually pleasing. Someone into Steampunk would enjoy the look of this watch very much, particularly if the back of the case were replaced by another front to show the movement at all times.

Beast’s Castle Sculpture from the Walt Disney Classics Collection Enchanted Places Series for Sale on ebay

This item has since been sold but I’m leaving this post up for reference purposes.

I am slowly going through my collection of Disneyana and deciding what things I no longer need. I am currently selling my sculpture of the Beast’s Castle from the Walt Disney Classics Collection. This was part of the Enchanted Places series. I purchased this back in 1996, the first year it was in production, as evidenced by the Donald Duck Hat imprint on the bottom. They produced this for 3 more years and it was finally retired in 2001.

This sculpture of the Beast’s Castle is very detailed and required 200 separate paint applications. It stands about 10 inches high, not including the wood base with brass plate giving the sculpture’s name. Each piece has a hand engraved serial number. This sculpture is numbered 014. The sculpture comes in it’s original box with a Certificate of Authenticity, Description card and a Commemorative Lithograph.

I’m asking $425 for this sculpture. It is now 16 years old. The Beauty and the Beast Animated Film came out 21 years ago. Beauty and the Beast was the first EVER Animated film to be nominated for an Academy Award. While it didn’t win the Academy Award for Best Picture it did win for Best Score and Best Original Song. This movie was a milestone in film history and owning this sculpture will be like owning a piece of History. In addition to all those accolades, Beauty and the Beast was also the first Disney Movie to be turned into a Broadway Musical, which ran on Broadway for 13 years.
